The joint liquidators are required by section 105 of the Insolvency Act 1986 to call a meeting of creditors at the end of the first year from the commencement of the liquidation and of each succeeding year. They are also required to report to the meeting on their acts and dealings and of the conduct of the liquidation during the preceding year.
Under section 4.59 of the Insolvency Rules 1986 the Court may order that notice of the meeting be given by public advertisement and not by individual notice to creditors.
In view of the nature of the company’s business there are potentially hundreds of thousands of consumer creditors for claims arising from the sale of goods and related warranty agreements. The cost of issuing a report to each of these creditors individually would be prohibitive.
Accordingly on 10 January 2005 the High Court in Birmingham ordered that the joint liquidators be at liberty not to send notices of creditors meetings to creditors whose claims are expected to be under £5,000. The Court also ordered that the information to be laid before each meeting of creditors should be made available on this website. Below is a link where you can download a copy of the annual report to all creditors and which has been sent to creditors whose claims are expected to exceed £5,000.
