Goods paid for but not received by customer

There are a number of customers who paid for goods in advance which the company was unable to deliver.

In many instances, the orders were fulfilled by PRG Powerhouse Limited, as a goodwill gesture, and these customers will no longer have a claim against the company. Where PRG were unable to complete the order in many cases, again as a goodwill gesture, they provided the customer with vouchers which could be redeemed at Powerhouse stores against other products.

If you are a customer who did not either receive their goods or vouchers to the full value of any payment made then you may be entitled to make a claim in the liquidation.

If you made your original payment using a credit card or a finance agreement then you may be entitled to make a claim from the original issuer/provider of your credit card or finance company under the terms of the Consumer Credit Act. Contact details are normally provided on your monthly statements.

If your payment is refunded in full by the original issuer/provider of your credit card or finance company you will no longer have a claim against the company. You should be aware that the original issuer/provider of your credit card or finance company is entitled to make a claim in the liquidation in respect of any payment made to you under the terms of the Consumer Credit Act.

If your claim is admitted in the liquidation then, based on present information, I anticipate you will receive a dividend although it is clear that the dividend will be a very small proportion of the value of your claim. In addition, due to the complexities of the case, it is likely to be some considerable time before any payment will be made.
