Customers owed money or goods for other reason

There are numerous other circumstances that could result in customers having a claim in the liquidation. These include:

You were issued with a credit note before 20 August 2003 , which cannot now be honoured.
You cancelled your warranty within 28 days and have not been refunded the cost.
You are due to be reimbursed for connection or delivery charges.
You were promised a refund for any reason before 20 August 2003 and have not received it.
You have a claim under the Sale of Goods Act for goods that were faulty, misrepresented or otherwise unfit for the purpose for which they were sold.
You were delivered the wrong goods or the goods were damaged.
Your goods developed a fault within the first 12 months and the manufacturer was Mitsubishi Black Diamond, Xenius, Kenwood Audio, Holmes Heating or Orion. (These manufacturers’ warranties had been bought out by the company.)
Damage was caused to your property during installation.
You were issued a cheque, which has not been honoured by the Bank.

If your claim falls into any of the above categories you may have a claim in the liquidation.

If you made your original payment using a credit card or a finance agreement then you may be entitled to make a claim from the original issuer/provider of your credit card or finance company under the terms of the Consumer Credit Act. Contact details are normally provided on your monthly statements.

If your claim is admitted in the liquidation then, based on present information, I anticipate you will receive a dividend although it is clear that the dividend will be a very small proportion of the value of your claim. In addition, due to the complexities of the case, it is likely to be some considerable time before any payment will be made.
