Warranties - Extracare Extended Service Protection

The company sold a number of these schemes over a period of time and the information relevant to you depends on when you purchased your Extracare warranty.

Purchased on or before 26 June 2000

Claims for repairs or replacements

If your claim is admitted in the liquidation then, based on present information, I anticipate you will receive a dividend although it is clear that the dividend will be a very small proportion of the value of your claim. In addition, due to the complexities of the case, it is likely to be some considerable time before any payment will be made.

Claims for Cashback

The liquidation of Powerhouse caused the discontinuance of the cash back payments under the Extracare extended warranty policies sold by Powerhouse before 26 June 2000.

My investigations have shown that the company effected insurance policies for the likely claims which would arise under the cash back element of these policies and customers are entitled to make a claim direct to the insurer for their cash back. I believe that I have now established the relevant insurers for these policies and I have passed details of all claims which I have received to them.

In order to make a valid claim customers must have complied with the terms and conditions of the policy.

If you wish to make a claim direct to the relevant insurer you will need to review your policy for the registration date. If your policy was registered before 31 October 1998 you should contact UK Insurance on 0113 390 4000. If your policy was registered between 1 November 1998 and 26 June 2000 you should contact Assurant Solutions plc at 117-119 Whitby Road, Slough, SL1 3DR. I regret that I have no further contact details for the insurers.

I am unable to comment on the validity of claims as it will depend on whether claimants have complied with the terms of the policy – and that is a matter which will be decided by the relevant insurer in due course. I am also unable to confirm whether they will pay claims in full – again that is a matter for the insurers.

Any claims which are rejected by the insurers as a consequence of failing to comply with the terms of the policy, such as not registering the claim within the initial registration period or because the claim has not been submitted within the relevant claim period, will also be rejected by myself if registered against the company. This is because any failure to comply with the terms of the policy amounts to a breach by the claimant and the company has no liability to pay the cashback if the terms or conditions are breached.

Claims must be made in writing and include copies of supporting documentation. Below is a link where you can download a form on which to make your claim. Claims should be sent to Mr A Graham, KPMG LLP, Restructuring, 2 Cornwall Street Birmingham , B2 2DL.

If you made your original payment using a credit card or a finance agreement then you may be entitled to make a claim from the original issuer/provider of your credit card or finance company under the terms of the Consumer Credit Act. Contact details are normally provided on your monthly statements.

Purchased between 26 June 2000 and 13 July 2003

I understand that in general Extracare Service contracts sold in the period between 26 June 2000 and 13 July 2003 and issued by ServicePlus Limited, are being administered by ServicePlus Administration, in accordance with the contract documentation.

All queries regarding these contracts should be directed to ServicePlus Administration, Pinnacle Place , 1 Elstree Way , Borehamwood, Hertfordshire , WD6 1NH . Their helpline number is 0870 605 8058.

It is ServicePlus’s responsibility to fulfil the contractual terms of any cash back agreement which you may have enetered into with them. I am unable to comment on the validity of your claim as it will depend on whether you have complied with the terms of the agreement – and that is a matter which will be decided by ServicePlus.

If your claim is rejected by ServicePlus and you are not satisfied with their decision you have the option to follow the ServicePlus complaints procedure outlined in the cash back agreement. I regret that I am unable to offer any assistance or advice with this process.

If your claim is rejected by ServicePlus, I will also have to reject your claim as you do not have a contractual relationship with Powerhouse.

The exception to the above is policies with the prefix “EXU”, and those not issued by ServicePlus Limited. Despite extensive enquires I have been unable to identify an underwriter in respect of policies issued after 26th June 2000 with an EXU prefix. If a repair is required, you are advised to have the repair carried out at your own expense and submit a claim to my office for the cost. Any claims in respect of the cash back element should also be made to me in accordance with the terms and conditions of the policy.

Claims must be made in writing and include copies of supporting documentation. Below is a link where you can download a form on which to make your claim. Claims should be sent to Mr A Graham, KPMG LLP, Restructuring, 2 Cornwall Street Birmingham , B2 2DL.

Purchased between 14 July 2003 and 20 August 2003

These policies were initially issued by the company and any claims under these policies will fall to be dealt with in the liquidation. However, following the acquisition of the business by PRG Powerhouse Limited, as a goodwill gesture to former customers, PRG arranged for the holders of these polices to be offered a replacement policy, free of charge, by Allianz Cornhill. Allianz Cornhill contacted all policyholders and issued new policy documentation to those customers who responded. If you are one of these new policyholders you will no longer have a claim against the company in respect of the original policy.

The offer is now closed so if you were not contacted by Allianz Cornhill, or did not respond to their initial correspondence, then regrettably you are unable to participate in the new scheme and remain a policyholder of the company.

If you require a repair, you are advised to have the repair carried out at your own expense and submit a claim to my office for the cost.

Any claims in respect of the cash back element should also be made to me in accordance with the terms and conditions of the policy.
